What is LAVI?
The Federal Act on Assistance to Victims of Offenses (LAVI) aims to support persons directly affected in their physical, psychological, or sexual integrity following an offense.
It notably provides for advice, assistance with procedures, and, under certain conditions, compensation or moral reparation when the damage suffered is not covered by other sources.
In which situations can compensation be requested?
A request for LAVI compensation can be considered when the perpetrator of the offense does not repair the damage, particularly if they are unknown, untraceable, or insolvent.
The situations concerned may include assaults, violence, sexual offenses, certain domestic violence, or other serious impairments to the victim's integrity.
Compensation and moral reparation
LAVI compensation can cover, under certain conditions, costs resulting from the offense that are not covered by third parties.
Moral reparation can also be requested when the impairment suffered is sufficiently serious. An analysis of the file allows determining the useful steps and elements to gather to assert the claim.
